Terms and Conditions – Domeinvanwijn.nl

Article 1 – Definitions

1. Domeinvanwijn.nl: The sole proprietorship established in the Netherlands, operating under the trade name Domeinvanwijn.nl, hereinafter referred to as “we” or “us”.
2. Customer: Any natural person or legal entity placing an order via our webshop.
3. Agreement: The purchase agreement concluded between Domeinvanwijn.nl and the customer.
4. Products: All wines and related products offered via Domeinvanwijn.nl.
5. Webshop: The online store accessible via domeinvanwijn.nl.

Article 2 – Applicability

1. These terms and conditions apply to all offers, orders, and agreements concluded via our webshop.
2. By placing an order, the customer expressly agrees to these terms and conditions.

Article 3 – Offer and Prices

1. All prices stated on our webshop include VAT and exclude shipping costs, unless expressly stated otherwise.
2. We reserve the right to change prices at any time. Orders already placed and confirmed will be executed at the agreed price.
3. Obvious errors or mistakes in pricing or product information are not binding.

Article 4 – Orders and Payment

1. Orders are processed only after full payment has been received via the available payment methods, including Mollie.
2. After placing an order, the customer will receive an order confirmation by email.
3. If an order cannot be fulfilled, the customer will be informed accordingly and any payment received will be refunded within 14 days.

Article 5 – Delivery and Shipping

1. Deliveries are carried out via our shipping partner Sendcloud.
2. We aim to deliver orders within [X] business days. This delivery time is indicative only and does not constitute a strict deadline.
3. Delays in delivery do not entitle the customer to compensation.
4. The risk of loss or damage to the products transfers to the customer at the moment of delivery.

Article 6 – Right of Withdrawal and Returns

1. The customer has the right to withdraw from the agreement within 14 days after receipt of the products without stating reasons, provided the products are unopened and in their original condition.
2. Return shipping costs are borne by the customer.
3. After receipt and approval of the returned products, the purchase amount will be refunded within 14 days via the original payment method.
4. Perishable goods, including opened bottles of wine, are excluded from the right of withdrawal.

Article 7 – Complaints and Warranty

1. If a product is defective or incorrectly delivered, the customer must notify us within 7 days via [email/phone].
2. We will assess the complaint and provide an appropriate remedy, such as replacement or refund.
3. We are not liable for damage resulting from improper or incorrect use of our products.

Article 8 – Age Restriction

1. The sale of alcoholic beverages to persons under the age of 18 is prohibited.
2. By placing an order, the customer confirms that they are at least 18 years of age. Age verification may be required upon delivery.

Article 9 – Liability

1. We are not liable for indirect or consequential damages, including loss of profit.
2. Our liability is limited to the purchase price of the relevant product.
3. We are not liable for delays or failures caused by force majeure.

Article 10 – Privacy and Data Protection

1. Personal data is processed in accordance with our privacy policy and applicable GDPR legislation.
2. Customer data is used exclusively for order processing and communication and will not be disclosed to third parties without consent, unless legally required.

Article 11 – Amendments and Disputes

1. We reserve the right to amend these terms and conditions at any time.
2. All agreements are governed exclusively by Dutch law.
3. Disputes will preferably be resolved by mutual agreement. If this is not possible, disputes shall be submitted to the competent court in the Netherlands.

Additional Provisions for Domeinvanwijn.nl

Article 12 – Shipping Limitation (No International Deliveries)

1. We deliver exclusively within the Netherlands.
2. Orders with a delivery address outside the Netherlands will be cancelled and the paid amount will be refunded within 14 days.

Article 13 – Business Customers

1. Business customers may place orders; however, purchases made for business purposes are excluded from the right of withdrawal.
2. Different return conditions apply to business purchases and may be discussed via [contact details].

Article 14 – Discount Promotions and Gift Vouchers

1. Discount codes and gift vouchers are not redeemable for cash and are valid until the stated expiry date.
2. Discounts cannot be applied retroactively to orders already placed.
3. Misuse of discount codes may result in cancellation of the order.

Article 15 – Force Majeure

1. In the event of force majeure, including but not limited to strikes, natural disasters, epidemics, government measures, or logistical disruptions, we are entitled to suspend delivery or terminate the agreement without liability.
2. The customer will be informed as soon as reasonably possible.

Article 16 – Intellectual Property

1. All content on our webshop, including texts, images, and logos, is the property of Domeinvanwijn.nl and may not be reproduced or used without prior permission.
2. Any infringement of intellectual property rights may result in legal action.
